WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT FOR THE BLUE COLLAR COOPERATIVE LLC WORKSHOP/CLASS ATTENDANCE
1. In consideration for receiving permission to participate in THE BLUE COLLAR COOPERATIVE CLASSES (hereinafter referred to as the Blue Collar Cooperative, class and/or workshop) I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE, THE BLUE COLLAR COOPERATIVE LLC, its agents, servants, volunteers, visitors or employees (hereinafter referred to as RELEASES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any of the property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASES, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.
2. I am fully aware of the unusual risks involved and hazards connected with activities and materials used in THE BLUE COLLAR COOPERATIVE CLASSES. Ihereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage of property owned by me, as a result of being engaged in such activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASES OR OTHERWISE.
3. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to my participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASES OR OTHERWISE.
4. It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above named RELEASES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Idaho.
5. IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement and the SAFETY PROCEDURES, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same. If I am executing this document as a parent/guardian of a minor child, I represent and warrant that I have the legal right to execute this Agreement on behalf of the minor and that the release, once executed by me, is fully enforceable in accordance with its terms. I agree to indemnify the Releasees in the event the representation is not accurate.
MEDIA RELEASE I understand that the Blue Collar Cooperative may take photos and/or videos of program participants during program activities and events for use in educational or promotional materials in print, multimedia, or web form. Photos/videos will only be used for purposes related to these Blue Collar Cooperative programs and their related partners. * Please contact us if you DO NOT wish to grant the Blue Collar Cooperative permission to use your (or your child's) photos/videos taken during a program.
THE BLUE COLLAR COOPERATIVE GENERAL SAFETY PROCEDURES/POLICIES THE FOLLOWING ARE TO BE APPLIED WHENEVER WORKING WITH OR AROUND TOOLS WHILE ATTENDING OUR CLASSES.
1. READ ALL INSTRUCTIONS CAREFULLY.
2. PROTECT YOURSELF. Always wear eye protection: either glasses, and/or shields. Protective eyewear must be certified to meet ANZI Z87.1. Personal eyewear must have polycarbonate lenses to provide proper protection.
3. WEAR PROPER APPAREL. No loose clothing, gloves, neckties, jewelry, or bracelets that can get caught in moving machinery. Open-toed shoes and sandals are prohibited in the classroom and shop. Long hair must be contained to avoid becoming entangled in equipment. Sleeves must either be buttoned at the cuff or rolled up above the elbow and loose clothing tucked in at the waist or wear an apron.
4. Only use Tools and/or Powered Equipment when and as instructed. Never pick up or attempt to use a tool that you have not been asked to handle or given clear instructions and oversight to use.
5. USE SAFETY GUARDS. Whenever possible, use the manufacturers provided safety guards on all tools and equipment. If a guard is to be disabled or inhibited to perform an operation, a staff member must be consulted first.
6. KEEP WORK AREAS CLEAN. Remove scraps and non-essential materials from tables and work surfaces before, during and after performing procedures. Stop tools before removing scraps, etc.
7. BE ATTENTIVE. Never operate tools and equipment under the influence of drugs, alcohol, or medication. Many cold remedies can impair attention and good judgment. Be aware of the people around and do not create a distraction that may cause them harm.
8. SECURE WORK. Use clamps or vise to hold work whenever practical. Be sure tools are properly mounted to the bench or tabletop.
9. DON'T OVERREACH. Maintain proper footinga n d never reach across a piece of operating machinery.
10. DO NOT FORCE TOOLS. Don't force the tool to d o more than its intended purpose.
